Gumtree Terms of Use

Introduction

Welcome to Gumtree. By accessing www.Gumtree.com and its related websites, services, applications or tools (Collectively referred to as "Gumtree") you are agreeing to these Terms of Use and to make sure that Gumtree works for everyone.

Gumtree is provided to you by Gumtree.com Limited, 27 Old Gloucester Street, London, WC1N 3AX, United Kingdom, registered in England and Wales with number 3934849. These Terms of Use constitute a legally binding agreement between you and Gumtree.com Limited and are effective for current users from 30th October 2025, and upon acceptance for new users. You accept these Terms of Use when registering a Gumtree account and by otherwise accessing Gumtree, including posting an Ad; or as otherwise indicated on Gumtree. About Gumtree

Gumtree operates an online marketplace where users can list, discover, buy, sell and arrange a wide variety of items, services and opportunities – including goods for sale, rentals, jobs, pets, and personal or professional services

Our role is to provide the platform and related tools that help buyers, sellers, and service providers connect.

We are not party to the actual agreements or transactions that take place between users. Any contract for the sale of an item, provision of a service, or other arrangement is made directly between the parties involved.

Gumtree does not own, hold, or take possession of items or animals listed on the platform, nor do we provide, supply, or manage services advertised by users. While we may offer optional tools — such as pricing suggestions, safety tips, payment facilitation, dispute assistance, or buyer protection schemes — these are provided solely for convenience and do not amount to guarantees.

Using Gumtree

As a condition of your use of Gumtree, you must be at least 18 years old and agree that you will comply with these Terms of Use and will not:

violate any laws;
violate the Posting Policies;
post any threatening, abusive, defamatory, obscene or indecent material;
post or otherwise communicate any false or misleading material or message of any kind;
infringe any third-party right;
distribute spam, chain letters, or promote pyramid schemes;
distribute viruses or any other technologies that may harm Gumtree or the interests or property of Gumtree users;
impose or contribute to imposing an unreasonable load on our infrastructure or interfere with the proper working of Gumtree;
copy, modify, or distribute any other person's content without their consent;
use any robot spider, scraper or other automated means to access Gumtree and collect content for any purpose without our express written permission;
harvest or otherwise collect information about others, including email addresses, without their consent;
copy, modify or distribute rights or content from Gumtree or Gumtree's copyrights and trademarks;
harvest or otherwise collect information about users, including email addresses, without their consent;
bypass measures used to prevent or restrict access to Gumtree;
use any tool that interferes with the normal functioning of Gumtree, including, without limitation, browser plug-ins (including, but not limited to, FreeTheTree), extensions, or other software which are designed to supplement, remove or otherwise change any of Gumtree's functionalities;
attempt to gain unauthorised access to or interfere with, damage or disrupt Gumtree or any of our or our partners’ software or infrastructure; or
sell any counterfeit items or otherwise infringe the copyright, trademark or other rights of third parties.

You are solely responsible for all information that you submit to Gumtree and any consequences that may result from your post. We reserve the right at our discretion to refuse or delete content that we believe is inappropriate or breaching these Terms of Use. We also reserve the right at our discretion to restrict a user's usage of Gumtree either temporarily or permanently or refuse a user's registration if you are in breach of any of the above. If we believe that you are breaching these Terms of Use in any way and/or behaving suspiciously on Gumtree, we may, at our discretion, inform other Gumtree users that have been in contact with you and recommend that they exercise caution.

The provisions in this clause relating to content on Gumtree should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).

Global Marketplace

Some of Gumtree's features may display your Ad on other sites, services, applications or tools (together a “Platform”) that are part of the Gumtree community, or on third party Platforms, including social media channels. By using Gumtree, you agree that your Ads can be displayed on these other Platforms and media channels. You may be subject to additional laws or other restrictions in the countries where your Ad is posted. When your Ad is posted on another Platform, you may be responsible for ensuring that it does not violate such other Platform's policies. We may remove your Ad if it is reported on Gumtree, or any third-party Platform, or if we believe it causes problems or violates any law or policy.

Fees and Services

Gumtree may charge a fee for certain services, for instance, if you are a business; listing an item under our Pets category; or where we charge a buyer protection fee for items purchased through our payment and delivery services. If the service you use incurs a fee, you'll be able to review and accept terms that will be clearly disclosed at the time you sign up for these services. Our fees are quoted in Pounds Sterling, and we may change them from time to time. We'll notify you of changes to our fee policy by posting such changes on Gumtree. We may choose to temporarily change our fees for promotional events or new services; these changes are effective when we announce the promotional event or new service and may be subject to additional terms that will be made available to you at the time.

You are responsible for paying the Gumtree fees when they're due. If you don't, without prejudice to any other right or remedy we may be entitled to under these Terms of Use or by law, we may limit your ability to use the services. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms or take you to court to recover owed fees.

Payment and delivery services on Gumtree

Gumtree has payment and delivery features available for selected categories on our platform. For payments, we have partnered with payment service provider Mangopay UK Limited to help us deliver secure payment processing, holding, payouts, refunds, and fund transfers.

Verification and KYC checks

To use the payment services via Mangopay UK Limited, you may be required to supply personal identifying information (e.g. name, address, nationality, date of birth, bank account details, proof of identity). We or our payment provider may require you to complete "Know Your Customer" checks. Failure or refusal may result in suspension or closure of the payment services.

Holding & Escrow

Payments made by buyers for eligible Ads will, unless otherwise specified, initially be held in an escrow or holding state under the control of our payment processor until the conditions for release have been met (e.g. confirmation of delivery, acceptance, or expiry of dispute-period).

Making payments

Buyers may pay using (as available and permitted):

Credit or debit cards
PayPal
Other payment methods we may support (e.g. digital wallets)

You are responsible for making sure that your payment details are accurate so that payments made on our site are safe and secure. Failure to do so may result in your transactions being cancelled and you may be required to prove a payment method is yours or that you authorised a payment.

Data Transfers & Providers

We may share payment and identity data with our payment providers, outsourced service providers, affiliates, or subcontractors as necessary to fulfil payment services. Please see our Privacy Notice for further information on how we use your personal data.

Payout Timing & Schedule

Subject to successful clearance, verification, and absence of holds or reserves, we will initiate disbursement of proceeds to your linked financial account (i.e. bank account).

Processing Delays & Errors

We (or payment providers) do not guarantee instantaneous settlement. Delays may occur due to banking procedures, fraud or compliance checks, regulatory constraints, or technical issues. We are not liable for delays or errors caused by external systems, except to the extent required by applicable law.

Item eligibility

Not all Ads on Gumtree are eligible for payment and delivery services. Gumtree will determine which items are eligible and will update the information in the Help Centre from time to time with a list of eligible categories.

Items will be eligible up to a price threshold that will vary by category. Further details can be found in the Help Centre.

User eligibility

The services are available for eligible Ads provided by private sellers only.

Buyer Protection

A Buyer Protection fee is added to each eligible transaction at checkout and this shall be calculated at checkout and shown on the Ad.

This fee is to help ensure secure payment processing with funds held until delivery is confirmed, provide dedicated customer support to assist with disputes, and assist with fraud prevention and risk monitoring.

Buyer Protection is automatically applied when you purchase an item using the “Buy Now” button and pay through our approved third-party payment provider. Buyer Protection is available for payment and delivery services only. Please note that Buyer Protection is not an insurance policy or legal protection scheme; it is an additional safeguarding service we provide in line with these Terms of Use and your statutory rights.

Buyer Protection may apply in the following cases:

Where the item is not received – the item fails to arrive within the estimated delivery timeframe.
Where the item is Significantly Not As Described (SNAD) – the item received is materially different from the description or photos (e.g. wrong item, counterfeit, undisclosed major damage).
Where the item is damaged in transit – where adequate proof of damage is provided.

Where you receive a full refund under Buyer Protection, we will also refund the corresponding Buyer Protection fee and any Delivery Fee you paid.

Making a Claim

If you wish to make a claim under the Buyer Protection policy, or as a seller your item is lost or damaged in transit, you can find further information in the Help Centre.

Delivery

Applicability of third-party carrier terms - By using the delivery services you acknowledge and agree that the relevant Carrier Terms which can be found below will apply between you and Gumtree for anything you send using the delivery service. As part of this you agree not to send any prohibited or restricted items in contravention of the Carrier’s terms, the lists of which can be found here.

You must package all items in accordance with correct weight and dimension limits for the delivery label provided to you. If you fail to correctly package or securely attach the delivery label to your package, Gumtree shall not be liable for any loss or damage caused to the package for failure to so.

If you under-declare the weight of a parcel, we may charge you the difference, add administration fees, and/or restrict your use of the delivery services. Repeated misdeclaration may lead to account suspension.

If your parcel is lost or damaged, information on how to claim can be found in the Help Centre.

If Gumtree incurs any costs or losses because someone else makes a claim against Gumtree as a result of you sending something in a way that doesn’t comply with the Carrier Terms; or if you’ve sold or attempted to sell something that infringes someone else’s intellectual property rights (for example, counterfeit goods), you will have to reimburse Gumtree for any costs or losses that we incur. If you are a business seller rather than a private individual then the amount you might have to pay Gumtree under this paragraph isn’t limited by any other part of these Terms of Use.

Listing Promotion Fees

You acknowledge that your Ads may be deleted from Gumtree where we believe these Terms of Use, including our Posting Policies, are breached, either directly or indirectly. If you have paid a fee for the display of an Ad, you may be entitled to a refund of such fee, however, we reserve the right not to refund Gumtree users for any fees paid for the use of Gumtree in the following cases:

If you breach, in our opinion, these Terms of Use, which include, without limitation, the policies;
If your Ads went live with exposure on the Gumtree sites, services, applications or tools, even for a limited time, and as a result they benefited from the service associated with the paid fee;
If we suspect any illegal activity, particularly where your Ads are placed in the Pets or Massage categories of Gumtree;
If your Ads are placed into "edit" mode and will go live to site once updated by you;
If you have removed your Ads yourself;
If you post duplicate Ads as defined in our rules regarding duplicate Ads; or
If we believe that your Ads are in a significantly wrong category.

Please note that the above list is not exhaustive. See the Refunds for Payments to Gumtree Help Page for more details on the cases in which you may, or may not, be entitled to a refund of such fees.

In addition to the Gumtree services, ancillary goods or services such as insurance or car finance may be advertised on Gumtree. Although users may offer financial products on their Ads, Gumtree is in no way involved or liable for any loss related to such transactions.

Display and placement of user Ads

We strive to create a community where users can find what they are looking for. Therefore, the appearance or placement of Ads in search and browse results will depend on a variety of factors, including, but not limited to:

users' location and search query / category selected;
adverts' category, content, location and date published; and
if the Ad has a paid-for promotion (see our Promoting an Ad help article for more information).

You may not have the opportunity to review all of the supplemental data relating to your Ad before posting it. Gumtree is not responsible for the accuracy of any third party supplied supplemental data. You continue to be responsible for ensuring that your Ads are accurate, do not include misleading information and fully comply with these Terms of Use and all Gumtree policies. Copyright Content

Gumtree contains content from us, you, and other users. Gumtree is protected by copyright laws and international treaties. Content displayed on or via Gumtree is protected as a collective work and/or compilation, pursuant to copyrights laws and international conventions.

You agree not to copy, distribute or modify content from Gumtree without our express written consent. You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in Gumtree. Without limiting the foregoing, you agree not to reproduce, copy, sell, resell, or exploit for any purposes any aspect of Gumtree (other than your own content). When you give us content, you grant us and represent that you have the right to grant us, a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise any and all copyright, publicity, trademarks, design, database and intellectual property rights to that content, in any media whether now known or to be discovered in the future including, without limitation, on any third party Platforms and media channels. In particular, by giving us content, you grant us the right to display such content on Platforms that are part of the Gumtree corporate group, and on other online marketplaces, social media channels, blogs, in all types of marketing communications and on all other Platforms. In addition, you waive all moral rights you have in the content to the fullest extent permitted by law.

Gumtree may at times use third party data suppliers to supplement the information you have provided in an Ad. This could include descriptions, product specifications and other content. You may use such information solely in connection with your Gumtree Ad while your Ad is on Gumtree. The information provided may be subject to copyright, trademark and/or other protections. You agree not to remove any such protected information and/or create any derivative works based on the content (other than by including them in your Ads). This permission is subject to modification or revocation at any time at Gumtree's sole discretion.

Artificial Intelligence

We may use Artificial Intelligence (AI) to enhance and optimise the services we provide, such as improving search relevance and improving your Ad posting experience. Our use of AI does not involve any automated decision-making that may concern you or similarly significantly affects you, as defined by data protection regulations like the GDPR.

Abuse

Gumtree and the Gumtree community work together to keep Gumtree working properly and the community safe. Please report problems, offensive content and policy breaches to us using the reporting system. Without limiting other remedies, we may issue warnings, limit or terminate our service, remove hosted content and take technical and legal steps to keep users off Gumtree if we think that they are creating problems, infringing the rights of third parties or acting inconsistently with the letter or spirit of our policies (including, without limitation, circumventing temporary or permanent suspensions or harassing the Gumtree employees or other users).

Keeping our Users Safe

To ensure a safe online environment for all our users in the United Kingdom, Gumtree is committed to complying with our duties under the UK Online Safety Act 2023. This means we have systems and processes in place designed to prevent, detect, and swiftly remove content that is illegal under UK law, in accordance with the Act's requirements and Ofcom's Codes of Practice.

By using Gumtree you also agree not to upload, post, share, or transmit any content that is illegal. This includes, but is not limited to, content related to:

Child sexual exploitation and abuse (CSEA);
Terrorism;
Incitement to violence or hatred
Fraudulent content;
Intimate image abuse (e.g., revenge porn);
Promotion or facilitation of suicide or serious self-harm;
Illegal drugs or weapons; and
Other criminal offences as defined by the Online Safety Act.

Actions that Gumtree will Take

Gumtree will proactively monitor, identify and remove illegal or offensive content appearing on our platform. Should Gumtree become aware of, or have reasonable grounds to believe that anything may be in contravention of our polices or these Terms of Use, we will take prompt action, which may include:

Removing or disabling access to the content;
Suspending or terminating user accounts; and
Reporting the content and user details to relevant law enforcement agencies.

Complaints and Disputes

You can contact us if you believe there to be any illegal or offensive content or behaviour on our platform or if you think Gumtree is not complying with our duty to remove harmful content. If you believe there to be a breach of contractual duty between you and us or failure of Gumtree to protect its user’s rights to freedom of expression or privacy you can also contact us via the Contact Us link. You may submit a claim under law if you believe there has been a breach of contract by Gumtree.

If you believe that we have incorrectly blocked you or a User or have incorrectly removed or taken down your Ads or content, you can let us know via the contact us section or seek further help via the Help Centre. Gumtree will review the decision and take appropriate action to reject or uphold the request.

For disputes between you and another Gumtree User, you should contact the other Gumtree User first and attempt to resolve the issue directly with them. If you are unable to resolve the matter, then you can contact us to escalate the matter further. Gumtree expressly disclaims that it will act as a mediator between Users of the platform and shall only be obliged to investigate and act in accordance with its obligations under its policies and these Terms of Use.

How we will deal with your complaint or reported content

Complaints will be assessed based on urgency and potential harms, prioritising User safety, fraudulent activity, policy violations and spam and nuisance reports. Gumtree shall aim to respond to a complaint within 7 days of submitting it.

Appeals

Gumtree will offer an appeals process for wrongful takedowns. If an appeal is unsuccessful, the User may ask in line with Gumtree’s complaints process for the decision to be escalated to a manager. The manager will review the decision and provide a decision in line with Gumtree's complaints escalations process.

Infringement

You are not permitted to post content that infringes the rights of third parties. This includes, but is not limited to, content that infringes on intellectual property rights such as copyright, design and trademark (e.g. offering counterfeit items for sale). A large number of products of all sorts are offered on Gumtree by private individuals. Entitled parties, in particular owners of copyright, trademark rights or other rights can report any advertisement which may infringe on their rights, and submit a request for such advertisement to be removed. If a legal representative of the entitled party reports this to us in the correct manner as set out below, infringing products will be removed by Gumtree.

Reporting an infringement

In order to participate in the Notice of Infringement Programme, you only need to complete a Notice of Infringement Form and email it to Gumtree at noticeandtakedown@gumtree.com. You can use this form,

The "Notice of Infringement" is intended to enable rights owners to ensure that products offered by Gumtree users do not infringe their copyright, trademark rights or other intellectual property rights. Financial Products

Gumtree operates solely as an introducer for the financial products advertised on this website (which includes unsecured loans and insurance). We do not provide any advice or give any opinions on the merits of any of the financial products that we advertise and users are advised to conduct their own research and seek independent financial advice before applying for any of these financial products.

Liability

Nothing in these Terms of Use shall limit our liability for fraudulent misrepresentation, or for death or personal injury resulting from our negligence or the negligence of our agents or employees.

We are not involved in the actual transactions between Users. As most of the content on Gumtree comes from other Users, we do not guarantee the accuracy of postings or user communications or the quality or legality of what's offered. You acknowledge that we cannot guarantee continuous, error-free or secure access to our services or that defects in the service will be corrected. While we will use reasonable efforts to maintain an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the operation and availability of our sites, services, applications or tools. We may suspend or withdraw or restrict the availability of all or any part of Gumtree for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

We are not responsible for viruses and do not guarantee that Gumtree will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs and platform to access Gumtree. You should use your own virus protection software.

Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of, or inability to use Gumtree, even if you advise us or we could reasonably foresee the possibility of any such damage occurring.

Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you. Despite the previous paragraph, if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of: (a) the total fees you paid to us in the 12 months prior to the action giving rise to liability; and (b) 100 Pounds Sterling. The above limit shall not apply to items eligible for payment and shipping services, where the total shall be up to the item’s agreed purchase price only.

Release

If you have a dispute with one or more Gumtree Users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known or unknown, arising out of or in any way connected with such disputes.

Third party rights

A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any Terms of Use but this does not affect any right or remedy of a third party specified in this Agreement or which exists or is available apart from that Act.

Data Protection and Privacy

By using Gumtree, you agree to the collection, transfer, storage and use of your personal information by Gumtree on servers located in the Netherlands and the United States as further described in our Privacy Notice.

You and Gumtree shall process personal data received under and/or in connection with these Terms of Use each as a separate and independent controller. In no event will Gumtree and you process personal data under and/or in connection with this User Agreement as joint controllers or in a controller-to-processor relationship. As such separate and independent controllers, you shall be individually and separately responsible for complying with the obligations that apply to you as a controller under applicable data protection law.

You shall comply with your obligations under applicable data protection law (including but not limited to the Regulation (EU) 2016/679 (EU General Data Protection Regulation “GDPR”)) and supplementing EU and local data protection law. This includes, but is not limited to the obligation to provide appropriate safeguards for the transfer of personal data to a third country or an international organisation. You shall process personal data received from Gumtree exclusively for the purpose(s) you received the personal data under and/or in connection with these Terms of Use. You shall erase the personal data received under these Terms of Use immediately after the respective purpose(s) has/have been fulfilled. Any further processing of the personal data is not permitted except when legally required (e.g., if a retention obligation applies).

Failure to abide with the aforementioned obligations may result in us taking action against you up to and including account suspension or termination.

As part of the services, Gumtree has access to various information about Users, including personal data. This includes information that users submit to Gumtree as part of the services (such as contact information or item descriptions) as well as information that is generated by the provision and processing of the services (such as ratings, sales analysis or communication) via Gumtree.com and its related websites, services, applications or tools, and you will receive such information where it is necessary for the processing of transactions (in particular, the contact information of the other User involved in a transaction) as well as aggregated information on the performance and analysis of your Ads, which are partly related to the data of other Users of the services (such as number of impressions of an ad, conversion rate or return rate).

Gumtree only shares information about Users with third parties if this is necessary for the provision of the services or if Gumtree is legally or contractually entitled to do so. Gumtree’s partners and their Privacy Policies can be found here.

Upon your request, we will delete the information you provided, or which was generated through your use of the services from your Gumtree account. Regardless, we maintain this information after the expiry of these Terms of Use if we are legally obliged or have a legitimate interest to do so. We will generally maintain aggregated data generated using the services (e.g. statistics about ads in a category). To request deletion of your data, please do so by accessing the Contact Us form.

Your account details and password

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify Customer Service.

General. These Terms of Use and the other policies posted on Gumtree constitute the entire agreement between Gumtree and you, superseding any prior agreements. No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

If we don't enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any part of these Terms of Use, the remaining parts of the Terms of Use will survive. We may automatically assign this agreement in our sole discretion in accordance with the notice provision below.

We may update this agreement at any time, with updates taking effect when you next post or 30 days after we post the updated policy on the Gumtree website, whichever is sooner. No other amendment to this agreement will be effective unless made in writing, signed by users and by us.

Except for notices relating to illegal or infringing content, your notices to us must be sent by registered mail to Gumtree.com Limited, 27 Old Gloucester Street, London, WC1N 3AX, United Kingdom. We will send notices to you via the email address you provide, or by registered mail. Notices sent by registered mail will be deemed received five days following the date of mailing.

Governing law

This Agreement shall be governed and construed in all respects by the laws of England and Wales. You agree that any claim or dispute you may have against Gumtree.com Limited must be resolved by the courts of England and Wales. You and Gumtree both agree to submit to the non-exclusive jurisdiction of the English Courts.

Application Use

Gumtree grants you the right to use the Gumtree application only for your personal use. You must comply with all applicable laws and third-party terms of agreement when using the application (e.g. your wireless data service agreement). The application may not contain the same functionality available on the www.gumtree.com website. Your download and use of the application is at your own discretion and risk, and you are solely responsible for any damages to your hardware device(s) or loss of data that results from the download or use of the application.

Intellectual Property – Applications

Gumtree owns, or is the licensee to, all right, title, and interest in and to its applications, including all rights under patent, copyright, trade secret, trademark, and any and all other proprietary rights, including all applications, renewals, extensions, and restorations thereof. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse-engineer, disassemble, or otherwise attempt to derive source code from any application and you will not remove, obscure, or alter Gumtree's copyright notice, trademarks or other proprietary rights notices affixed to, contained within, or accessed in conjunction with or by any Gumtree application.

Prohibited Countries Policy and Foreign Trade Regulation - Applications.
