FREQUENTLY ASKED QUESTION ABOUT SPOUSE VISAS:
:-What is a spouse visa?
Applications can be made for a Spouse/Partner visa if you are married (or co-habiting as an unmarried couple) to a British citizen or a person who has indefinite leave to remain or has settled status.
:-How to get a spouse visa
• Both you and your partner are over the age of 18
• You are legally married or in a civil partnership that is recognised by the UK or have been living together for at least 2 years as an unmarried couple
• You have passed an approved English language test
• You have adequate accommodation
• You fulfil the financial requirement
:- How long does it take to get a spouse visa?
A spouse visa allows partners and spouses of British citizens and people settled in the UK to immigrate to the UK. Spouse visa is initially granted for 33 months for applications submitted from overseas and for 30 months for applications submitted in the UK. The processing time is dependant whether the application is made from within the UK or from overseas and on how complex your application is.
:- What are the financial requirements for a SPOUSE VISA?
To obtain a spouse visa, applicants must prove that they meet the financial requirement: this can be met thorough salaried and non – salaried income, self- employment, through dividends or as a salaried director of a company, income from investments or property rental, pension or cash savings.
UK Immigration rules state that that the sponsor (as well the applicant jointly, if in the UK with valid leave) need to show a minimum gross annual income of at least £18,600. One way to prove that your sponsor (or the applicant, if they are in the UK with valid leave) can meet this financial requirement is through employment, if they have been working with the same employer for a minimum period of 6 months with an annual salary of £18,600 or more.
In support of your application, you must provide last 6 months payslips, corresponding bank statements for the last 6 months showing receipt of salary and a letter from your employer. Where possible, you should also provide an employment contract. If the applicant is not employed, you can still meet the financial requirement if you can show evidence of cash savings of at least £62,500 (held in your account for at least 6 months prior to the date of your application).
:- How long does it take to obtain a UK Fiancé , partner or spouse visa from overseas?
UK fiancé, partner and spouse visas are applications made under the settlement category. The Home Office usually takes up to 12 weeks from the date of biometric appointment to make a decision on these applications from overseas (standard processing time). In some countries, applicants could choose to pay for a speedy decision to be made on their application by choosing to pay for ‘priority service’. Applications submitted using priority service will usually be decided within 6 weeks from the date of your biometric appointment.
If you have applied using the priority service and your application is not straightforward, you may have to wait longer, but your application will still be put at the front of the queue at every stage of the decision-making process.
The applicant might have to wait longer for a decision if their application is not straightforward and more information is required before a decision is made, for example:
• If your supporting documents need to be verified
• If you need to attend an interview
• Because of your personal circumstances (for example if you have a criminal conviction).
